Herb is a partner in the Philadelphia office of Fox Rothschild LLP and is a nationally recognized authority in the complex field of eminent domain law. He is the founding member of the firm's Condemnation Group. Herb has represented clients in eminent domain cases in many states, including Pennsylvania, New Jersey, New York, Kentucky, Texas and California. He is a co-author of the annual supplements to the Pennsylvania treatise on condemnation law, Snitzer on Eminent Domain Law, and has co-authored a chapter on the condemnation of avigation easements that is included in the national treatise, Nichols on Eminent Domain.

Herb has served for 15 years as eminent domain counsel to The Regional Airport Authority of Louisville and Jefferson County (Kentucky) in the expansion of the Louisville International Airport. He also served as eminent domain counsel to the City of Philadelphia for the new commuter runway at the Philadelphia International Airport. He has represented landowners as well as condemning agencies in both “right to take” cases and valuation cases before boards, commissions, and courts at the trial and appellate levels. Cases in which Herb has served as counsel include such unique properties as sanitary landfills, quarries, coal reserves, cemeteries, casinos and industrial facilities that forge auto parts, fabricate metal products, bottle water and bake cookies and crackers.

He has lectured before many groups, including the Pennsylvania Bar Institute, the Philadelphia Chapter of the American Institute of Real Estate Appraisers, the Eastern Regional Conference of the American Institute of Real Estate Appraisers, the Main Line Board of Realtors and the Pennsylvania Land Title Association. Herb also taught real estate law at Manor Junior College.

In 2004 and 2005, Herb was named a "Pennsylvania Super Lawyer" as selected by his peers statewide, representing the top 5 percent of all lawyers in the Commonwealth, in a joint project of Law & Politics Magazine and Philadelphia Magazine .

Herb is a former member of the Committee of Seventy and served as a member of the executive board and as chairman of “Seventy.” Herb is president of the Board of Directors of CORA Services, Inc., a social services agency providing services to children and their families. Herb also volunteered his time and talents to the Crime Prevention Association and has served as president and chairman of the board.

He is a former chairman of the Harvard Law School Fund for the Philadelphia area. Herb is a trustee of the Pennsylvania Land Title Institute and a member of the board of directors of J/CHAI. He is also member of Lambda Alpha International, a national real estate economics society. He is a former member of the Real Estate Advisory Board of Immaculata College and served as its chairman for 25 years.

Admitted to practice in the Supreme Court of the United States, Herb is a member of the American, Pennsylvania and Philadelphia Bar Associations.

Herb graduated from Dickinson College and Harvard Law School.
