Herb is a partner in the firm's Real Estate Department and is a recognized authority in the field of Pennsylvania eminent domain law. Herb's practice involves a broad range of real estate issues, including eminent domain, zoning and land development and commercial real estate development. He is a member of the firm's Condemnation Law Group as well as a member of the firm's Zoning and Land Use Group.
Herb has represented numerous property owners in complex condemnation cases. He has represented Philadelphia Electric Company in the condemnation of numerous flowage easements along the Perkiomen Creek in order to supply additional water to the Limerick Nuclear Power Plant. These flowage easements were obtained from property owners throughout Bucks and Montgomery Counties and involved extensive litigation to establish the right to the easement as well as the amount of damages. Herb has represented property owners whose property has been taken by eminent domain and has filed a variety of de facto taking petitions against condemnors on behalf of property owners whose land has been taken without the filing of formal proceedings.
In addition to Herb's condemnation practice, he represents numerous developers, builders and property owners with respect to their land use, zoning and subdivision and land development issues throughout the counties surrounding Philadelphia. Herb's land use practice involves the representation of both commercial and residential developers and includes tax assessment appeals, mortgage foreclosures and complex financing.
Herb is active with the Home Builders Association of Bucks and Montgomery Counties. He is a frequent lecturer on land use-related subjects in the Commonwealth of Pennsylvania. Herb is a former president of the Bucks County Bar Association, and is a member of the House of Delegates of the Pennsylvania Bar Association as well as a member of the American Bar Association.
Herb received his J.D. from New York Law School in 1976, where he was the assistant editor-in-chief of the New York Law School Law Review and received the Dean's Award for Outstanding Editorial Contribution. He graduated from Villanova University in 1973.
